Withdrawal Instructions
Your 14-day right of withdrawal — and why it lapses on download when buying digital sheet music.
These instructions apply to consumers — that is, to people who are not making the purchase in the course of a trade or profession.
First things first: your right of withdrawal lapses on purchase
We sell sheet music as PDFs, and you are meant to be able to download it immediately after paying. That is precisely why, before buying, you confirm two things with separate boxes: that we should begin delivery before the withdrawal period expires, and that you thereby lose your right of withdrawal.
Once delivery begins — that is, as soon as the downloads are available to you — your right of withdrawal lapses (§ 18 (1) 11 of the Austrian FAGG). This is not a clause we invented but the condition on which digital content may be delivered immediately at all.
You receive that confirmation again in writing in the confirmation email. What follows therefore applies where delivery has not yet begun — and independently of it your warranty rights remain: if a file is faulty or missing, write to us.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The period is 14 days from the day the contract was concluded.
To exercise the right of withdrawal you must inform us (Art of Cibulka — Eigenverlag, Eva Cibulka, Popelkaring 24, 8045 Graz, Austria, email cibulka@gmx.at, phone +43 650 8765 111) of your decision by an unequivocal statement — for example a letter sent by post or an email. You may use the model form below, but you are not required to.
To meet the deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In no event will you be charged any fees as a result of such reimbursement.
Withdrawal ends your right to use the files. Files already downloaded are to be deleted and printouts destroyed.
